A recent Full Commission Opinion issued on January 10, 2023, by Commissioner Rappaport details the nuances regarding a compensable versus non-compensable injury by accident in today’s legal landscape in the context of the actual risk a Claimant must prove. In Agyemang v. The Gardens at Warwick Forest, JCN VA00001874767, the Full Commission denied a claimant’s claim for benefits relating to an accident that occurred on May 1, 2021. COMMISSION ISSUES NEW 30-DAY ORDER FORM BEGINNING AUGUST 26, 2022

The Commission has issued an updated 30-Day Order form, and began using it Friday, August 26, 2022. The 30-Day Order was created by statute in 2020 with the enactment of Va. Code §65.2-601.2 that requires that the Commission send an Order to the employer upon the filing of an initial claim for benefits, and requires that the Employer respond to that Order within 30 days, or face statutory fines.
